Jodi Ulrich Coaching Inc.  (hereinafter, “Company”, “Our” or “We”) are committed to safeguarding the privacy of our web site visitors and this Privacy Policy sets out how we will treat your personal information.

Our Site uses cookies. By using our Site, you accept the privacy practices contained in this Privacy Policy and consent to our use of cookies in accordance with the terms of this Privacy Policy. You are encouraged to review this Privacy Policy whenever you visit our Site to make sure you understand how any personal information you provide will be used.

1. What Information Do We Collect?

We may collect, store, and use personally identifiable and non-personally identifiable information as described in more detail in the sections that follow.

A. Personally Identifiable Information

Voluntary submissions of personally identifiable information can occur for various reasons, such as if you request to receive information about our services, if you subscribe to one of our mailing lists, or if you purchase one of our products.

We may collect, store and use the following kinds of personal information:

  • information about your computer and about your visits to and use of this website (including your IP address, geographical location, browser type and version, operating system, referral source, length of visit, page views, website navigation).
  • information relating to any transactions carried out between you and us on or in relation to this website, including information relating to any purchases you make of our goods or services.
  • information that you provide to us for the purpose of registering with us, including name, email, phone, and other relevant information to provide you with the service you’re requesting and important information.
  • information that you provide to us for the purpose of subscribing to our website services, email notifications and/or newsletters, text messages, and voicemail broadcasts.
  • any other information that you choose to send to us.

Most of your customer information is stored on our secured servers and in a third-party Customer Relationship Manager (CRM) system called Klaviyo and payments processed through a third-party payment processor called Stripe. Your credit card information is not stored by us and is instead stored securely by established PCI compliant payment processors.

By submitting your email address on our Site, you agree to receive emails from us. You can cancel your participation in any of these email lists at any time by clicking the opt-out link or other unsubscribe option that is included in the respective email. You can customize your email and other preferences (such as the lists you are subscribed to) by following the instructions contained in the Section entitled “Manage Preferences”. We only send emails to people who have authorized us to contact them, either directly, or through a third party. We do not send unsolicited commercial emails.

By submitting your email address, you also agree to allow us to use your email address for custom audience targeting on sites like Facebook, where we display custom advertising to specific people who have opted-in to receive communications from us.

If you wish to stop seeing ads from us on Facebook, you can turn off the ad by using the following steps:

  1. From within Facebook, go to the advertisement you want to turn off.
  2. Click on the drop-down arrow in the top corner of the ad (that may be in the top right corner or top left corner).
  3. Click on “Hide ad”.

You can also customize the ads you see in Facebook across all advertisers by using the following steps:

  1. Log in to your Facebook account and click “settings”.
  2. Click on “Ads”.
  3. On that page you will see a list of options you can choose to limit and/or block the information Facebook shows to advertisers.

If you wish to stop seeing ads from us in Google Ads, you can turn off the ad by using the following steps:

  1. Go to the advertisement you want to turn off.
  2. Click on the x in the top left corner.
  3. Click on “Stop seeing this ad”.

Other ad platforms we may use in the future have similar ways you can turn off any ad from us to stop seeing it.

 

B. Non-Personally Identifiable Information (“Cookies”)

We may also collect various types of non-personally identifiable information to enhance your experience, measure our site’s activity to identify future improvements, and compile aggregate data to better serve site visitors.
For example, we may use “cookies” as outlined in Section 2 “Cookies”, session logs, web beacons, GIF/pixel tags, banner adds, third-party click tracking analytics tools (such as Google Analytics), third party retargeting networks that may display our advertisements to you on other web sites that you visit to remind you about us, and third party networks that serve user-requested emails (e.g. for a refer-a-friend email) to collect non-personally identifiable or other aggregated information about site visitors.

Cookies are files containing an identifier (a string of letters and numbers) that is sent by a web server to a web browser and is stored by the browser. The identifier is then sent back to the server each time the browser requests a page. This enables the web server to identify and track the web browser. We may use both “session” cookies and “persistent” cookies on the Site. Session cookies will be deleted from your computer when you close your browser. Persistent cookies will remain stored on your computer until they are deleted or until their specified expiry date is reached. We use Google Analytics to analyze the use of our Site. Google Analytics generates statistical and other information about website use by means of cookies, which are stored on users’ computers. The information generated relating to our Site is used to create reports about the use of our Site. Google will store this information. Google’s privacy policy is available at: https://www.google.com/policies/privacy/. Our advertisers, payment services providers, and affiliates may also send you cookies.

Most browsers allow you to reject all cookies, whilst some browsers allow you to reject just third party cookies. For example, in Internet Explorer (version 9) you can refuse all cookies by clicking “Tools”, “Internet options”, “Privacy”, and selecting “Block All Cookies” using the sliding selector. Blocking all cookies will, however, have a negative impact upon the usability of many websites. Because there is not yet a common understanding of how to interpret web browser-based “Do Not Track” signals other than cookies, we do not currently respond to “Do Not Track” signals that are undefined.

3. International Data Transfers

Information that we collect may be stored and processed in and transferred between any of the countries in which we operate in order to enable us to use the information in accordance with this Privacy Policy.

Information which you provide may be transferred to other countries which do not have data protection laws equivalent to those in force in the Canada.

In addition, personal information that you submit for publication on the Site will be published on the Internet and may be available, via the Internet, around the world. We cannot prevent the use or misuse of such information by others.

4. Commitment to Data Security

All information collected from you is stored in a technically and physically secure environment. We will take reasonable technical and organizational precautions to prevent the loss, misuse or alteration of your personal information. All electronic transactions entered into via the Site will be protected by encryption technology.

We use SSL encryption to protect sensitive information online, and we do everything we can to protect user information offline. You acknowledge that the transmission of information over the Internet is inherently insecure, and we cannot guarantee the security of data sent over the internet. Therefore, any information that you transmit to us, you do so at your own risk.

You are responsible for keeping your password and other login details confidential. We will not ask you for your password.

Furthermore, employees, contractors, and vendors who have access to your personally identifiable information in connection with providing services for us are required to keep the information confidential.

5. Third Party Actions

We do not control and are not liable for the actions of any third parties who we may promote and/or link to from our Site. We pride ourselves in recommending quality companies, but have no control over the actions of those third parties, the content they provide, or their privacy practices. While we are not liable for any of the actions of those third parties, you should feel free to give us feedback from time to time on your experiences with any third parties to whom we work with so that we may enhance our future service to all customers.

6. Children’s Privacy

We do not knowingly intend to collect personally identifiable information from children under 18 years of age. If your minor child has provided us with personally identifiable information, you may contact us at the email or mailing address listed in Section 9: Contact Us if you want this information deleted from our records. We will then make reasonable efforts to remove your child’s information from the database that stores the information.

7. IP Addresses

We may use your IP address to help prevent fraud, to help diagnose problems with our server, to gather broad demographic information, and to offer you products and services.

8. Updating or Removing Your Personal Information

If you are a subscriber to one of our mailing lists, you can customize your information and the mailing lists you have subscribed to at any time by simply clicking the Unsubscribe or Manage Preferences links at the bottom of any email you receive from us.
If you have questions about the use, amendment, or deletion of Personal Information that you have provided to Us, or if you would like to opt out of future communications from us, please contact us using the information below in the Contacting Us section.
If you wish to request that we forget you from our database, please send an email to hello@jodiulrich.com with the subject line “Forget Me” and explain in the body of the email that you are asking to have your personal data deleted. To protect user privacy, you must send such a request from the account information we have on file or the request will not be honored. We reserve the right to retain any data that we are required to maintain under applicable laws. Some data will be anonymized rather than deleted; this means that some of the data will be held in a form that cannot be connected to you personally. Please be aware that once we delete your data, we will be unable to “undelete” it.

10. Severability

General Terms

By accessing the resources and services provided Jodi Ulrich Coaching Inc. – including our online courses and live coaching sessions – you confirm that you are in agreement with and bound by the terms of service contained in the Terms & Conditions outlined below. These terms apply to the entire website and any email or other type of communication between you and Jodi Ulrich Coaching Inc.

Under no circumstances shall Jodi Ulrich Coaching Inc. team be liable for any direct, indirect, special, incidental or consequential damages, including, but not limited to, loss of data or profit, arising out of the use, or the inability to use, the materials on this site, even if Jodi Ulrich Coaching Inc. team or an authorized representative has been advised of the possibility of such damages. If your use of materials, recommendations, or advice from this site results in the need for servicing, repair, or correction of equipment or data, you assume any costs thereof.

Jodi Ulrich Coaching Inc. will not be responsible for any outcome that may occur during usage of our resources. We reserve the right to change prices and revise the resource usage policy at any time.

Restrictions

You agree not to, and you will not permit others to:

  • License, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose, or otherwise commercially exploit the website or make the platform available to any third party.

  • You acknowledge that the Jodi Ulrich Coaching Inc. body of work – including website, course curriculum, webinars, blogs, and other resources – are protected by applicable trademark, copyright, patent, and other intellectual property laws. Accordingly, you may not copy, reproduce, distribute, or alter any materials from this body of work without Jodi Ulrich Coaching Inc.’s prior express permission, except for personal, non-commercial use only.

 

Payment

If you register to any of our programs or coaching services, you agree to pay all fees or charges for the Service in accordance with the fees, charges, and billing terms in effect at the time that each fee or charge is due and payable. Unless otherwise indicated in an order form, you must provide Jodi Ulrich Coaching Inc. with a valid credit card (Visa, MasterCard, or any other issuer accepted by us) or other Payment Provider as a condition to signing up for a subscription or course. Your Payment Provider agreement governs your use of the designated credit card account, and you must refer to that agreement and not these Terms to determine your rights and liabilities with respect to your Payment Provider. By providing Jodi Ulrich Coaching Inc. with your credit card number and associated payment information, you agree that Jodi Ulrich Coaching Inc. is authorized to verify information immediately, and subsequently invoice your account for all fees and charges due and payable to Jodi Ulrich Coaching Inc. hereunder and that no additional notice or consent is required. You agree to immediately notify Jodi Ulrich Coaching Inc. of any change in your billing address or the credit card used for payment hereunder. Jodi Ulrich Coaching Inc. reserves the right at any time to change its prices and billing methods, either immediately upon posting on our Site or by e-mail delivery to you.

Any legal fees, court costs, or other costs incurred in the collection of delinquent undisputed amounts shall be the responsibility of and paid for by you.

No contract will exist between you and Jodi Ulrich Coaching Inc. for the Service until Jodi Ulrich Coaching Inc. accepts your order by a confirmatory e-mail, SMS/MMS message, or other appropriate means of communication.

You are responsible for any third-party fees that you may incur when using the Service.

Warranties

The Services are provided to you “AS IS” and “AS AVAILABLE” and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, Jodi Ulrich Coaching Inc., on its own behalf and on behalf of its affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the website, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice. Without limitation to the foregoing, Jodi Ulrich Coaching Inc. provides no warranty or undertaking, and makes no representation of any kind that the website will meet your requirements, achieve any intended results, be compatible or work with any other software, websites, systems or services, operate without interruption, meet any performance or reliability standards or be error free or that any errors or defects can or will be corrected.

Without limiting the foregoing, neither Jodi Ulrich Coaching Inc. nor any Jodi Ulrich Coaching Inc.’s provider makes any representation or warranty of any kind, express or implied: (i) as to the operation or availability of the website, or the information, content, and materials or products included thereon; (ii) that the website will be uninterrupted or error-free; (iii) as to the accuracy, reliability, or currency of any information or content provided through the website; or (iv) that the website, its servers, the content, or e-mails sent from or on behalf of Jodi Ulrich Coaching Inc. are free of viruses, scripts, trojan horses, worms, malware, timebombs or other harmful components.

Limitation of Liability

Notwithstanding any damages that you might incur, the entire liability of Jodi Ulrich Coaching Inc. and any of its suppliers under any provision of this Agreement and your exclusive remedy for all the foregoing shall be limited to the amount actually paid by you for the website.

To the maximum extent permitted by applicable law, in no event shall Jodi Ulrich Coaching Inc. or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, for loss of data or other information, for business interruption, for personal injury, for loss of privacy arising out of or in any way related to the use of or inability to use the website, third-party software and/or third-party hardware used with the website, or otherwise in connection with any provision of this Agreement), even if Jodi Ulrich Coaching Inc. or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.

Waiver

Except as provided herein, the failure to exercise a right or to require performance of an obligation under this Agreement shall not affect a party’s ability to exercise such right or require such performance at any time thereafter nor shall be the waiver of a breach constitute waiver of any subsequent breach.

No failure to exercise, and no delay in exercising, on the part of either party, any right or any power under this Agreement shall operate as a waiver of that right or power. Nor shall any single or partial exercise of any right or power under this Agreement preclude further exercise of that or any other right granted herein. In the event of a conflict between this Agreement and any applicable purchase or other terms, the terms of this Agreement shall govern.

 


    Shipping Policy

    We provide digital coaching services only. No physical shipping is required. Course access details will be emailed to you within 24 hours of purchase.


    Returns & Refunds Policy

    Your satisfaction is important to us.

    If, for any reason, you are not completely satisfied with any service that we provide, don’t hesitate to contact us.

    We offer refunds within 10 days of the course start date. After 10 days of program commencement, the purchase is considered final.
